What to Know About Breach Bonds
The Department of Homeland Security (DHS), previously known as the Immigration and Naturalization Service (INS), holds the authority to breach (forfeit) an Immigration Bond. However, there are potential defenses against such breaches. These defenses might be evident within the documents themselves or found in the individual’s “A” file.
The DHS Form I-323, titled “Notice – Immigration Bond Breached,” details the reasons and circumstances under which the noncitizen failed to appear for removal (deportation), an interview, or departure (in the case of a Voluntary Departure Bond).
